The Federal Mediation and Conciliation Service (FMCS) has long been recognized as the nation’s premier mediation and conflict resolution organization. FMCS was created by Congress as an independent agency of the United States government in 1947, and is staffed by 200 skilled mediators stationed in 73 strategically-located field offices throughout the country.

FMCS has provided training in the techniques of mediation and conflict resolution to attorneys, human resource managers and other appropriate employees of state and federal government agencies authorized by Presidential Executive Order 12871 and the Administrative Dispute Resolution Act of 1996. This has traditionally been done in large groups of employee representatives and managers, one agency at a time.

Now, to make this valuable training more accessible to individuals, FMCS is offering courses in practical conflict resolution skills and techniques in locations throughout the United States. Classes are taught by veteran mediators, giving participants a unique opportunity to interact with and learn from these experienced conflict resolution professionals.

 

Mediation Skills

This dynamic 20-hour course provides the full range of basic skills required for mediating disputes. Integrating theory and practice, this course focuses on developing a conceptual understanding of the process, and enhances the participants skills in facilitating difficult conversations, creative problem solving, negotiation and communication. The course is highly interactive and the majority of time is spent in specially designed role-plays which reflect the federal environment. Upon completion of the course, participants can hone their skills through agency or shared neutrals programs.

The training includes:

Understanding negotiations
Introduction to mediation fundamentals
Tools and techniques of mediation
Mediation simulations
Mediation skills in different situations
Ethical considerations in mediation

Facilitation Skills

This highly-interactive course provides a rigorous introduction to facilitation skills and techniques. Designed for government employees who want to build and/or fine-tune their facilitation skills, the course draws heavily on exercises and simulations to give the participants opportunities to practice facilitating and to learn from one another. Videotaping will be used to highlight critical elements of the facilitation process and to provide in-depth feedback to participants.

Facilitation of large and small meetings
Facilitating interest-based negotiations
Dealing with contentious issues
Managing problem behaviors
Maintaining composure in difficult situations
Conveying neutrality
Drawing out people who don't participate actively
Cross-cultural communication
Agenda-setting
Using flip charts
Reaching closure

Interest-Based Bargaining

Known by many names and practiced in many variations and settings: Win-Win Bargaining, Mutual Gains, Principled or Interest-Based Negotiation, Interest-Based Problem Solving, Best

Practice or Integrative Bargaining, the Interest-Based Bargaining (IBB) concept is a different way to negotiate. In the right situation, IBB provides an alternative, replacing traditional positional bargaining with a process of joint problem-solving.

IBB assumes that mutual gain is possible, that solutions which satisfy mutual interests are more durable, that the parties should help each other achieve a positive result. In the collective bargaining context, IBB can enhance the labor-management relationship.

Training includes:

Understanding the basic concepts of IBB
Understanding how IBB differs from traditional bargaining
Techniques to enable the process to work successfully
The Six-Step Process of IBB and its application in simulations

CONFLICT RESOLUTION/MEDIATION IN A DIVERSE WORKPLACE

The demographics of the American work place are changing rapidly as more women and workers with different ethnic, racial, social, and religious backgrounds join the labor force. The most rapidly increasing groups coming into the labor movement today are immigrants, women, and minorities. The issues raised by an increasingly diverse work force go far beyond the traditional collective bargaining issues of wages, hours, and working conditions. Adapting to and accommodating new work force demographics will be a challenge to American business, and will test organized labor's ingenuity to organize and represent a more racially and culturally diverse work force effectively.

To prepare government and employee leaders for these changes in the workforce, FMCS training addresses:

The impact of changing demographics and culture in the workplace
Understanding of how we describe ourselves and others
Stereotyping, prejudices and discrimination, and their effect the workplace
The value of the skills and abilities that each individual brings to the workplace
Implementation strategies for diffusing workplace conflict
