Statement on Supreme Court Case Involving State Taxation of Natural Gas Marketers

WASHINGTON, DC -- Nicholas Bush, president of the Natural Gas Supply Association (NGSA), expressed disappointment today about the Supreme Court's decision in the case of GM vs. Tracy, Tax Commissioner of Ohio.

"While it is important to recognize the rights of an individual state over its businesses," Bush said, "it is difficult to achieve a prosperous national economy without consistent and fair rules for interstate commerce. This decision does not further the development of a national, competitive marketplace for natural gas."

The case, in which NGSA filed an amicus brief last spring, challenged a lower-court decision permitting the State of Ohio to impose a tax on non-utility gas marketers. NGSA contended that the tax violated the "Commerce Clause" in Article I of the U.S. Constitution.

The Natural Gas Supply Association represents integrated and independent companies that produce and market domestic natural gas. Established in 1965, NGSA encourages expanded use of natural gas and a regulatory climate that fosters competitive markets.
