FAQ Arbitration Panel Selection Part 1404 Arbitration Policy

Q. How does one apply to become an arbitrator?

  1. Obtain an application form and materials by writing to Ms. Peggie Shoulders, Roster Administrator, Office of Arbitration Services, FMCS, 2100 K Street, N.W., Washington, DC 20427 or by calling her at (202) 606-5111.

Q. What is FMCS looking for in an arbitrator?

  1. Generally speaking, FMCS is looking for individuals who are (1) experienced, competent, and acceptable in decision-making roles in the resolution of labor relations disputes, or (2) have extensive experience in relevant positions in collective bargaining, and (3) are capable of conducting an orderly hearing, can analyze testimony and exhibits, and can prepare clear and concise findings and awards within reasonable time limits. Applicants are asked to submit copies of five actual arbitration awards they have rendered while serving as an arbitrator in a collective bargaining dispute where he/she has been chosen by the parties.

Q. How do I request a panel of arbitrators from FMCS?

  1. Submit a typed Form R-43 (Request for a Panel) to FMCS.

Q. Is there a charge for FMCS services?

  1. The charges are $30 for a panel of arbitrators, $20 for a direct appointment (when it is not the result of a panel process), and $10 plus 10 cents a page for a list of arbitrators in a specific area plus their biographical sketches.

Q. From where will the arbitrators for a panel be selected?

  1. If both parties do not otherwise specify, our computers will conduct a random selection of seven arbitrators from a geographic area close to the site of the hearing.

Q. What happens after we receive a panel of seven arbitrators?

  1. Both parties must inform us of their mutual selection or of their preferred choices so that we may determine the most acceptable arbitrator. We will then appoint the arbitrator and instruct him/her to contact the parties and arrange for a hearing date. The parties are also informed. The arbitrator updates FMCS on the status of the case until final notification that an award has been submitted. The arbitrator then informs us of his charges and the issues that were involved.
